Not true.  There is no prohibition on the type of equipment legal for use on the ham bands, as long as FCC regs including technical standards, licence class, bands and sub-bands are observed. If one could get spurious emissions down to specs, that piece of crap would be perfectly legal, although I couldn't imagine any legitimate ham in his right mind paying $500 for it.
